About This Course

Many commercial property disputes arise because leases are poorly drafted or parties are unaware of their legal rights. However, disputes often develop gradually through communication failures, misunderstandings regarding obligations, or disagreements over how lease provisions should operate in practice. What begins as a relatively minor issue can quickly escalate into costly litigation involving rent arrears, service charges, alterations, forfeiture, or lease renewals.

This session explores the practical realities of commercial leasehold property disputes from a litigator's perspective. Participants will examine the warning signs that disputes are developing, the common mistakes that increase legal exposure, and the strategies that landlords, tenants, managing agents, and advisers can use to resolve issues before they become formal proceedings. The session focuses on practical risk management and dispute avoidance across the commercial property sector.

Key Topics Discussed:

  • Why commercial property disputes escalate
  • Rent, service charge, and arrears disputes
  • Alterations, assignments, and landlord consents
  • Forfeiture and lease enforcement
  • Lease renewals and contested negotiations
  • Communication and early dispute resolution strategies
  • Litigation risks and costs considerations
